Consumer Guarantees

Under the Uniform Commercial Code (UCC), as adopted in most U.S. states, products sold by Lyvella come with an implied warranty of merchantability, meaning they must be fit for their ordinary purpose. Where you have made a particular purpose known to us and relied on our recommendation, an implied warranty of fitness for that particular purpose may also apply. Our products must also match their description and any sample, image, or demonstration shown on lyvellashop.com.

These protections exist regardless of any written warranty and cannot be waived or excluded by us except as permitted under applicable state and federal law.

Your Remedies

If a product you purchased from Lyvella does not conform to these guarantees, you are entitled to certain remedies, depending on the nature and severity of the issue.

You are entitled to

  • Repair, replacement, or refund for a materially defective product
  • Compensation for reasonably foreseeable loss or damage caused by a defective product
  • Repair or replacement for minor, non-material defects

Guarantees do not apply if

  • You misused the product
  • You were aware of the problem before purchasing
  • You simply changed your mind

Change-of-mind returns are handled separately under our Returns & Refunds Policy, which offers a voluntary 30-day return window in addition to the statutory guarantees described on this page.

Material vs Minor Defects

A material defect occurs when a product has a problem that would have prevented the purchase had it been known in advance, is significantly different from its description, is substantially unfit for its ordinary purpose, or is unsafe to use. In these cases, you may choose your preferred remedy: repair, replacement, or refund.

For minor, non-material defects, Lyvella may choose to repair the product in the first instance, provided this is done within a reasonable time and at no cost to you.

Time Limits

Implied warranty and breach-of-contract claims under the UCC are generally subject to a statute of limitations of up to four years from the date of delivery, although the exact period can vary depending on your state of residence. This period exists independently of, and in addition to, the 30-day window offered under our own Returns & Refunds Policy.

Statutes of limitations for warranty and consumer protection claims vary by state. If you are unsure of the time limit that applies to you, we recommend contacting your state Attorney General's consumer protection office, listed in Section 07 below.

How to Make a Claim

We aim to resolve every claim directly and fairly.

Most issues are resolved quickly through direct contact with our support team. We would always rather assess your situation and put things right than have a claim escalate unnecessarily.

Exclusions

Consumer guarantees described on this page do not apply where you misused the product, were aware of the problem before purchasing, or simply changed your mind. Products that have been altered, damaged through improper use, or used for a purpose other than their intended purpose may not be eligible for a remedy under this page, though our Returns & Refunds Policy may still apply.
